If your entry is selected, a professional gardener will personally visit to makeover your garden. There will be one winning family featured on Weekend Today each month, from April to September. Official Rules

April 9, 2005

PRELIMINARY INFORMATION:  No purchase necessary. Void where prohibited. You must be a legal U.S. resident physically residing within the Continental United States (residents of Hawaii, Alaska, Puerto Rico and Guam are excluded from entry and participation) who is 18 years of age or older as of April 9, 2005.  Contest begins on April 9, 2005 at 12:00 am and ends at 6:00pm September 30, 2005. 

TO ENTER: To enter, go to www.weekendtoday.msnbc.com and complete the online entry form ("Entry Form").  The Entry Form will ask for your name, telephone number, email address and other information. You will then be asked to submit an original essay of 200 words or less, telling us why you would like Weekend Today to makeover your home’s garden ("Submission"). Then press the submit button to submit the Entry Form, along with the Submission. All Submissions must be original, truthful, unpublished, created solely by the submitting entrant, must not have been submitted in any other competition, and must not infringe upon any rights of any third party, including but not limited to copyright, trademark, and rights of privacy and publicity.  Entries and Submissions generated by a script, macro or other automated means will be disqualified. Entries and Submissions that are incomplete, illegible or corrupted are void and will not be accepted.  All Submissions and Entry Forms become the property of the NBC Universal, Inc. ("NBC") and will not be acknowledged or returned.  Any Submission that, in the sole discretion of Weekend Today and NBC, is deemed defamatory, harassing or otherwise inappropriate for publication will be disqualified.  Limit one entry per household.  Multiple entries received from any person or e-mail address thereafter will void all such additional entries.  Entries that are incomplete or illegible are void and will not be accepted.  All entries must be received before 6:00 PM Eastern Time on September 30, 2005.   By participating, entrants unconditionally accept and agree to comply with and abide by these Official Rules and the decisions of Weekend Today.

SELECTION OF WINNER AND ELIGIBILITY: Six (6) winners will be selected, on rolling basis beginning on April 9, 2005, by Weekend Today ("judges") from all eligible entries received.  Judges will evaluate entrants’ Submissions based on the following criteria: Strength of Argument 75%; Creativity 15% Location of Garden 10%.  The six essays that compellingly make the case that entrant should win the Prize will be selected as potential winners.  Winners will be selected in the sole discretion of Weekend Today. Weekend Today will notify each winner by phone and/or mail and/or at the email address provided by potential winner. Additionally in the selection process, WEEKEND TODAY may elect to conduct an optional telephone interview with potential winners and their families..  By entering the Contest, entrants agree to waive any right to claim any ambiguity or error in these Official Rules, or the Contest itself, and agree to be bound by these Official Rules and by all decisions of the judges and/or NBC, whose decisions are binding and final. Winners will be required to sign and return an affidavit of eligibility and liability and publicity release within three (3) days of notification. If potential Winner declines or cannot be reached after a reasonable effort has been exerted, any prize notification is undeliverable, or in the event of non-compliance with any of these requirements, the prize will be forfeited, and an alternate winner may be selected by the judges from the remaining eligible entries. Entrants must also be of good moral character.  Weekend TODAY reserves the right to exclude anyone convicted of a crime  (other than moving violations of a misdemeanor type that did not involve personal injury, drugs or alcohol).  Entrant must have nothing in their background that would be an embarrassment to NBC News or Weekend TODAY, and entrants may not be elected officials or currently running for any political office (local, state or federal).  Potential Winners may be required to undergo a background check.  Weekend TODAY reserves the right to exclude applicants for these or any other reasons, in Weekend TODAY’s sole editorial discretion.

Employees of NBC and its respective advertising and promotion agencies, its parent, subsidiary and joint venture companies, and members of employees' immediate families (spouses, parents, children, and siblings and their spouses) and members of the households of any of the above are not eligible.

Please note that by entering you agree to undergo a background check conducted by WEEKEND TODAY, if the show so elects, and, if necessary, to sign waiver forms authorizing the release of personal and background information.

If for any reason any of the Potential Winners do not meet any of the above eligibility requirements in Weekend Today’s sole discretion, the Judges may disqualify the entrant and/or select an alternate Potential Winner.  Weekend Today reserves the right to make public personal information about the entrants on-air, prior to, during, or following the Contest.

PRIZE:  There will be six (6) Grand Prizes awarded, one in each month from April 2005 to September 2005, consisting each of the following: a professional gardener selected by Weekend Today will makeover the garden of your home.  The style, quality, contents, placement and all other aspects of the garden makeover will be selected and installed by Weekend Today and the professional gardener, in their sole discretion, and provided to the winner.  Entrants agree that if selected as a Winner, entrant will permit Weekend Today to makeover their home’s garden, in Weekend Today’s sole discretion, and to have the new garden videotaped for television, even if the entrant doesn't like the new garden selected and installed by Weekend Today. The estimated retail value of all 6 Grand Prizes collectively is $12,000, approximately $2,000 per Prize.  This prize cannot be transferred by Winner or redeemed for cash and is valid only for the services and materials detailed above, with no substitution of prize by winners.  Limit one prize per family or household.  Winners must be willing and able to permit a crew from Weekend Today (including the professional gardener), to enter their homes and garden to film the Winner, the Winner's family and the Winner's home and garden before, during and after the garden makeover (the "Footage") and agree that the Footage is owned by NBC and may be broadcast by NBC at any time, including in segments on home decoration and gardening that may be broadcast on Weekend Today in April 2005 through September 2005. Notwithstanding the above, Weekend TODAY is under no obligation to broadcast the Footage and any decision to do so is in its sole discretion. Winner must also agree to appear with their families on Weekend Today in connection with winner's garden makeover (in Weekend's Today's sole discretion).

DISCLAIMER: Winner assumes all liability for any injury or damages caused or claimed to be caused by his or her participation in the contest and/or the acceptance and/or use of any prize, and releases NBC, its parent, subsidiaries, affiliates, officers, directors, and employees, (“Released Parties”) from any such liability.  Released Parties assume(s) no responsibility for any injury or damage to participants or to any other person's computer relating to or resulting from entering or downloading materials or software in connection with this contest. Released Parties are not responsible for telecommunications, network, electronic, technical or computer failures of any kind, for inaccurate transcription of entry information, errors in any promotional or marketing materials, errors in these rules, for any human or electronic error,  including but not limited to the administration of this Contest or Prizes, or for entries that are stolen, misdirected, garbled, delayed by computer transmissions, lost, late, damaged, or postage due. Entry constitutes permission (except where prohibited by law) to use winner's name, city, state, likeness, voice and use and exploit the Submission for the purposes of advertising, promotion and publicity, in all media now known or hereafter discovered, worldwide, without notice, review or approval by winner and without additional compensation. Entrants must be the registered subscriber of the email account from which the entry is made.  Entries will be declared made by the authorized account holder of the e-mail address submitted at time of entry. Failure to comply with these rules may result in disqualification from this promotion. NBC and Weekend Today reserve the right to withdraw the transmission of this contest or permanently disqualify from any promotion any person it believes has  violated these rules.

The failure of Weekend TODAY and NBC to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of Weekend TODAY and NBC (excepting compliance with applicable codes and regulations) or other force majeure event will not be considered a breach of these Official Rules.
