The third time was the charm for the guy trying to get close to Halle Berry.

The Oscar winner has obtained a temporary restraining order against a man who was arrested late last night after allegedly making his third straight foray onto her Beverly Hills property, E! News has confirmed.

Sounds like a good move on Berry's part, considering.

Richard Franco, who was booked at the LAPD's Hollywood Station on suspicion of felony stalking, has a lengthy criminal record and recently served jail time on a battery charge. He remains in custody pending an arraignment hearing.

The 27-year-old Franco was spotted at around 11 a.m. on Saturday scaling the outer wall around Berry's home. The actress herself called the cops, but a member of her household staff told him to scram and he was gone by the time officers arrived.

Berry stated in today's filing: "I immediately ran into my security room and watched the video monitor as the intruder scaled my fence and went into my driveway."

Franco was allegedly back in action at around the same time on Sunday, and again cops were called after, according to Berry, she was in her kitchen to grab a Diet Coke and she saw the trespasser staring at her through her glass kitchen door.

Last night, however, Berry's private security team was waiting for him and Franco didn't disappoint. He was arrested at around 11:15 p.m. and surveillance cameras on the property captured what went down.

Berry has demanded that Franco stay away from her and her 3-year-old daughter, Nahla, as well as her residence, car and anywhere they might be. A hearing on making the TRO permanent is scheduled for Aug. 1.
