Results of Smith baby’s DNA test due Tuesday

Howard K. Stern is not expected to continue his fight for custody of Anna Nicole Smith’s daughter if DNA tests reveal photographer Larry Birkhead is the child’s father.

Results of the DNA test of baby Dannielynn are due to be revealed in a Bahamas court room on Tuesday. While the two men have not reached an official agreement on paper, Birkhead confirmed to Access Hollywood on Monday that Howard will not continue his custody fight if Larry is proved to be the father.“We talked and I guess what Howard wants to do and what we both agreed upon is we both want to do what’s best for Dannielynn,” Birkhead told Access. “Any time anyone says they’re not gonna fight you in this kind of battle is music to my ears.”

Though some have speculated Stern may have agreed to cease his paternity battle in exchange for his continued presence in the fight for a share of Smith’s late husband J. Howard Marshall’s billion dollar estate, Birkhead told Access no such deal was made.

“There was no exchange — one thing for another,” Birkhead revealed. “It was just two people wanting to do the right thing.”

In fact, Birkhead said he has not engaged in any discussions regarding continuing the legal proceedings over Marshall’s estate for Dannielynn either.

“I haven’t even thought about it,” he said. “I’ve had my plate full . . . Other issues are at stake [like] where I will reside with the baby.”

With the DNA results due in less than 24 hours, Birkhead showed great emotion during Monday’s interview. The photographer said he was excited over the impending DNA test results, but Birkhead also revealed he has been struck with incredible sadness over the death of Anna Nicole Smith.

“I haven’t had time to grieve and that hit me a little bit,” he revealed. “It’s just a variety of emotions and you just have to balance that.”

Before she passed away, Smith herself was fighting Birkhead in court over Dannielynn. The photographer told Access despite the battle, he believes Anna would look favorably on his legal moves regarding the child.

“There was a public battle. On the surface it appeared we were bitter enemies, but [behind the scenes] we were exchanging emails,” he said. “I can hear her saying ‘good job dummy.’”

If he is revealed as the father Tuesday morning, Birkhead said raising Dannielynn without Anna Nicole will be difficult.“It’s tough,” he said through tears. “I think that I’m just gonna be looking over my shoulder all the time for Anna.”
