Prosecutors are urging a judge to forgo prison terms and sentence Anna Nicole Smith's psychiatrist and lawyer-boyfriend to felony probation, community service and fines.
The suggestion is in a sentencing memorandum filed Tuesday in the case of Dr. Khristine Eroshevich and Howard K. Stern who are scheduled for sentencing Thursday in Los Angeles. They were convicted of obtaining prescription drugs for the late Playboy model under false names.
Their lawyers want their convictions reduced to misdemeanors, dismissal of charges or a new trial. They say using fake names to protect celebrities' privacy is common practice.
Los Angeles Superior Court Judge Robert Perry has the option to send them to prison for up to three years and eight months.
