Eligibility: The ANCHOR FOR TODAY SWEEPSTAKES (“Promotion”) is open only to persons who, at the time of entry, are legal residents of, and are physically present in, the 48 continental United States and the District of Columbia (excluding Puerto Rico, Guam and the US Virgin Islands) and who are eighteen (18) years of age or older. Employees of NBC Universal, Inc., Telescope, Inc., MSNBC LLC, their advertising and promotion agencies and any other entity involved with the development or administration of this Promotion, and their subsidiaries, divisions, affiliates and related companies (“Contest Entities”), immediate family members and/or those living in the same household of such employees are not eligible to participate or win. Entries must be received by the times stated below to be eligible for the drawing. By entering the Promotion, participants are bound by and agree to these Official Rules. All federal, state and local laws and regulations apply.
Sponsor: The Sponsor of the Promotion is The Today Show (the “Sponsor”).
Promotion Period: The Promotion begins at 9:00 am (ET) on February 19, 2007 and ends at 5: 00 p.m. (ET) on February 28, 2007 (the “Promotion Period”).
How to Enter: On each day from February 19 through February 22 and from February 26 through February 28, 2007 during the Promotion Period, viewers will be invited to vote for one of several contestants for the “ANCHOR FOR TODAY” promotion in order to enter to win the Grand Prize. There will be a total of seven (7) daily sets of contestants (the “Daily Contestants”) viewers may vote for during the Promotion Period. All viewers who vote for the Daily Contestants will be entered to win the Grand Prize. The Daily Contestants for each day and respective voting choices will be posted and updated on www.today.msnbc.com and will be announced in a promotional spot on the Today Show (“Today”) each day from February 19 through February 22 and from February 26 through February 28, 2007 during the Promotion Period. Viewers may vote for a Daily Contestant from the time the Daily Contestants are announced on Today until 5:00 p.m. EST that same day. The outcome of the voting for Daily Contestants will be subject to the Official Rules for the “ANCHOR FOR TODAY” promotion (the “Competition”).
How To Enter by Cell Phone/Vote by Cell Phone: If you have a text messaging capable cell phone from a participating carrier, you may enter the Promotion by voting for your choice for the Daily Contestant once prompted to during the promotional spot on Today, by sending a text message to short code 33088 with your vote for the Daily Contestant. For example, if the Daily Contestants are: 1. Able, 2. Baker, 3. Charlie and 4. Daniel,” you will send a text message with the number corresponding to your choice. A premium text message charge of $.99 will apply to all text message entries sent to enter Promotion. In addition, standard text messaging rates apply to all text message entries sent and received in connection with the Promotion. You may stop receiving text messages at any time by responding “end”, “stop” or “quit” to the thank you text message or to any of the messages. For every vote for a Daily Contestant submitted via text messaging, you will receive one (1) entry into the random drawing to select the Grand Prize Winner. You may vote no more than ONE (1) TIME by text message each day. Votes/entries by text message in excess of one (1) per day will be voided. Please use caution and do not drive while entering the Promotion. You may vote for the Daily Contestant after the Daily Contestant choices have been presented on TODAY until approximately 5: 00 p.m. ET that same day.
Free Method of Entry Online/ Vote online: To enter the Promotion without using a text messaging capable cell phone, visit www.today.msnbc.com and complete the online registration, including your vote for the Daily Contestant presented on TODAY during that day of the Promotion Period. You may vote for the Daily Contestant after the Daily Contestant choices have been presented on TODAY until approximately 5:00 p.m. ET that same day. You may vote not more than ONE (1) TIME online each day. Online votes/entries in excess of one (1) per day will be voided.
LIMIT ONE (1) VOTE/Entry per day per method of entry (text message or online) each day from February 19 through 22 and February 26 through 28 during the Promotion Period for a total of Seven (7) Votes/Entries per method of entry during the Promotion Period. Any Additional Votes / entries will be voided.
Conditions for Participation and Validation of Entries. Entries generated by a script, macro, robotic or other automated means will be disqualified. You may enter up to one (1) time per method of entry per day from February 19 through February 22 and from February 26 through 28 during the Promotion Period, systems permitting, however, USE OF COMPUTER PROGRAMS TO ENTER AND/OR OTHER AUTOMATIC ENTRY METHODS, (SUCH AS HACKS OR BOTS), REGARDLESS OF METHOD OF ENTRY IS STRICTLY PROHIBITED. Sponsor reserves the rightto disqualify, and block or discard any entries from any individual who enters by any kind of electronic, mechanical or other automated means or otherwise tampers with or hacks the entry process as determined by the Sponsor in its sole discretion. Sponsor also reserves the right, in its sole discretion, to cancel, modify or suspend the Internet, electronic and/or text-messaging portions of the Promotion in the event of a computer virus, bugs, tampering, unauthorized intervention, fraud, technical or system failure or disruption, force majeure or any other causes which, in its sole opinion, corrupt the administration, security, fairness, integrity, or proper operation of the Promotion. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. Please note, by entering, you agree that if selected as a Grand Prize winner, Sponsor has the right to announce your name, home city, and state, and to air your voice live on-air during the Show. Sponsor is not responsible for late, lost and/or incomplete entries, which will be disqualified.
Random Drawing: The Grand Prize Drawing will be conducted by employees of Sponsor from all eligible entries received on or about March 2, 2007.
Grand Prize. The Grand Prize consists of one (1) Sharp Aquos Flat Panel LCD 37 inch television (Approximate Retail Value: $1,699.00). Entrants selected must comply with all terms and conditions of these Official Rules and winning is contingent upon fulfilling all requirements The manufacturer’s limited warranty shall apply to the prize awarded and no other warranty, representation or guarantee is provided to winner in respect to the prize. All prize details not specified herein are at the sole discretion of the Sponsor. All federal, state and local taxes are the sole responsibility of Grand Prize winner.
Due to the nature of television, the broadcast date and time of each episode of the TODAY SHOW is subject to change. In the event TODAY is cancelled or preempted after an episode of the TODAY is already airing, and in the event any portions of the Promotion are canceled, modified or suspended, the Grand Prize will be awarded from among those eligible entries received prior to cancellation or preemption. The outcome with respect to Daily Contestants is subject to the Official Rules of the ANCHOR FOR TODAY Promotion.
Winner Notification: Potential winner will be notified by phone and/or email. Sponsor will make three (3) attempts to contact the potential winner at the phone number or email address provided online or at the cell phone number used to enter within five (5) days from the time of the winner selection. If Sponsor is unable to reach a potential winner via phone or email within this time frame, he/she will be disqualified and an alternate will be selected. The potential winner (or the parent/legal guardian if winner is a minor in his/her state of residence) will be required to execute and return a notarized affidavit of eligibility/release of liability and/or publicity release (where legal) within seven (7) days of attempted notification. If any potential winner cannot be contacted or fails to sign and return the affidavit of eligibility and liability/publicity release within the required time period (if required), potential winner forfeits prize even though his/her name may have been shown/announced on air. If prize notification or prize is returned as undeliverable, potential winner forfeits prize. In the event that a potential winner is disqualified for any reason, Sponsor will award the prize to an alternate winner. Odds of winning a prize depend on number of eligible entries received during the Promotion Period.
General Conditions:
a. By entering, entrants fully and unconditionally agree and accept to be bound by these complete Official Rules and the decisions of Sponsor, which shall be final. Sponsor has the right to modify these rules in its sole discretion for clarification purposes without materially affecting the terms and conditions of the Promotion.
b. Except where prohibited, Grand Prize winner grants to Sponsor and its advertising agencies the right to use, and publish his or her proper name, likeness, voice, opinions, biographical information and state and announce on-air Grand Prize winner’s name, home city and state in any media to promote Sponsor and the Promotion without additional compensation.
c. Entrants enter at their own risk. Contest Entities are not responsible for and shall not be liable for: (i) late, lost, delayed, damaged, misdirected, incorrect, incomplete, ineligible or unintelligible entries; (ii) telephone, electronic, hardware, software program, network, Internet or computer failures or difficulties; (iii) errors in transmission; (iv) any condition caused by events beyond the control of Sponsor that may cause the Promotion to be disrupted or corrupted; (v) any injuries, losses, or damages of any kind caused by a prize or resulting from acceptance, possession, use or misuse of a prize, or from participation in the Promotion; or (vi) any printing or typographical error in any materials associated with these Official Rules or the Promotion generally. Entrants assume all liability for any injury or damages caused or claimed to be caused by his or her participation in the Promotion and/or the acceptance and/or use of any prize, and release Sponsor and its respective officers, directors, employees, parents, subsidiaries and affiliates from any such liability. Contest Entitiesand their respective officers, directors, employees, parents,subsidiaries and affiliates assume no responsibility for any injury or damage to participants or to any other person’s computer relating to or resulting from entering or downloading materials or software in connection with this Promotion.
PLEASE NOTE THAT A HIGH VOLUME OF ENTRIES, ONLINE OR BY SMS (TEXT MESSAGING), OR TECHNICAL DIFFICULTIES WITH THE SYSTEM, MAY RESULT IN TEMPORARY INABILITY TO ENTER THE PROMOTION OR A DELAY IN THE PROCESSING OF ENTRIES SUCH THAT YOUR ENTRY IS NOT RECEIVED IN TIME TO PARTICIPATE. SPONSOR AND ADMINISTRATOR ARE NOT RESPONSIBLE OR LIABLE SHOULD ANY ENTRY NOT BE RECEIVED DUE TO SUCH DELAYS.
Sponsor may prohibit any entrant or potential entrant from participating in the Promotion, if at the sole discretion of Sponsor, such person shows a disregard for these Official Rules, or acts (1) with an intent to annoy, abuse, threaten, or harass any other entrant, Sponsor, or its agents or representatives; or (2) in any other disruptive manner.
d. In the event of a dispute as to the identity of an entrant, the authorized account holder of the cellular phone or email address used to enter, if applicable, will be deemed to be the entrant. “Authorized account holder” of a cellular phone is the natural person in whose name the phone has been issued and to whom services are billed. “Authorized account holder” of an email address is defined as the natural person who is assigned to an email address by an Internet Access provider, on-line service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.
e. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the participant and Sponsor in connection with the Promotion, shall be governed by and construed in accordance with the laws of New York without giving effect to any choice of law or conflict of law rules or provisions which would cause the application of the laws of any jurisdiction other than the State of New York. Sponsor’s and Administrator’s decisions as to all matters related to the administration of the Promotion and selection of the Grand Prize winner are final.
Winner’s List: The name of the Winner will be posted on www.today.msnbc.com until May 2, 2007.
