Though his last court battle ended without resolution, Larry Birkhead tells “Access Hollywood” he is optimistic he will be able to bring his daughter, Dannielynn, home soon.

“Access” has learned that to bring home his child with late model Anna Nicole Smith, the birth certificate for the 7-month-old must be changed to reflect his paternity. Currently the certificate lists Howard K. Stern as the baby's father.

Birkhead will have to change the name at the General Registry Office in the Bahamas to receive a passport for the child.

Birkhead recently confirmed to “Access” he has the support of Stern, which is likely to help speed the transfer process along. He is, however, still embroiled in a court battle with Smith's mother, Virgie Arthur, who has been working to strike a visitation agreement.

There is no doubt the court fight has taken its toll on Birkhead, who revealed to “Access Hollywood” he has lost almost 20 pounds. Currently he is said to be “under the weather.”
