TODAY’S “AND THE WINNER IS…” CONTEST
Official Rules
February 21, 2005

No purchase necessary. Void where prohibited or restricted by applicable federal or state laws and regulations.

1. TO ENTER:
The Contest begins on Monday February 21, 2005,  at 7 AM Eastern Time and all entries must be received by no later than Friday, February 25, 2005 at 8 PM Eastern Time ("Contest period"). You may only enter the Contest once. 

To enter, go to www.today.msnbc.com, click on the "And The Winner Is..." Contest icon, then select your picks for who you think will win six of the following top Academy Awards(r) categories on Sunday night, February 27, 2004 (best picture, best director, best actor, best actress, best supporting actor and best supporting actress). You will also be required to enter your name, phone number and address where you will be between 7:30AM Eastern Time and 9:00AM Eastern Time on Monday,  February 28, 2005.

2. SELECTION OF WINNER:The entrant who correctly predicts the greatest number of winners of the categories listed on the contest form will be the Winner. If there is a tie among such entrants ("Potential Winners"), the Winner will be selected at random by TODAY representatives on or about February 27, 2005 ("Judges") from the pool of Potential Winners. The Judges decisions are final and binding.  All entries become the property of NBC and will not be acknowledged or returned.  No more than one entry per email address or household.  Multiple entries received from any person or email address thereafter will void all such additional entries.  By completing this application, entrants agree to receive e-mails and/or other materials from NBC and MSNBC (collectively "NBC").  For more privacy information, please see the Privacy Policy and Terms of Use for MSNBC.com: http://www.msnbc.com/m/info/terms.asp

The winner's name may be announced live on TODAY on February 28, 2005, schedule permitting.  In addition, TODAY may contact winner on the telephone during that broadcast or even may surprise the winner at his or her home between 7:30AM Eastern Time and 9:00AM Eastern Time on Monday, February 28, 2005, in TODAY's sole discretion.

3. ELIGIBILITY:
The Contest is open only to legal residents of the continental United States and the District of Columbia (RESIDENTS OF ALASKA, HAWAII, GUAM and PUERTO RICO ARE EXCLUDED)who are at least 18 years of age as of February 21, 2005. 

Employees, officers, directors, agents, representatives and immediate family and household members of NBC Universal, Inc. ("NBC"), MSNBC Cable LLC ("MSNBC"), NBC's affiliated TV station or Web site, and their parent, affiliate and subsidiary companies are not eligible to participate in the Contest or to win.

If for any reason and at any time the potential winner does not meet any of the above eligibility requirements in TODAY's sole discretion, the Judges may select an alternate winner at random from the remaining eligible entrants and may disqualify the entrant.

4. PRIZE:
The Prize is a walk on role for the winner in an NBC Universal production (“NBCU Production”) and a trip for two (2)to Hollywood .  The trip to Hollywood consists of: two (2) round-trip coach airfares for Winner and travel companion from the closest major airport to Winner's home to Los Angeles, CA; a two night's stay at an area hotel (single room/double occupancy);. All travel and hotel arrangements and selections shall be determined by TODAY its sole discretion. TODAY reserves the right to provide ground transportation in lieu of air transportation. Regarding all travel provided by TODAY, certain restrictions may apply.  Travel must be completed on dates selected by TODAY or winner forfeits the prize.  Travel companion must be 18 years of age or older or Winner must be travel companion's parent or legal guardian.

The NBCU Production and the nature of the walk on role will be determined in the sole discretion of NBC.  The NBCU Production producers are not obligated to broadcast or otherwise use or exploit the NBCU Production or any part thereof.  All details of the walk-on role to be determined by NBC, in NBC’s sole discretion, subject to availability and production exigencies.  Winner must be available during the NBCU Production’s production schedule and on the dates selected by NBC. If the NBCU Production is cancelled prior to Walk-On Prize Winner’s appearance, or in the event that any prize component is not available for any reason, then remaining elements of prize shall constitute full satisfaction of NBC’s prize obligation to Winner and no additional compensation will be awarded.

The approximate estimated value of the Prize is $1,500, one thousand five hundred dollars.  The walk on role has no monetary value.  TODAY and NBC reserve the right to substitute a similar prize of equal or greater value at its sole discretion.  Odds of winning depend on the number of entries received.  All taxes and all other expenses not set forth above, costs or fees associated with the acceptance and/or use of any prize are the sole responsibility of the winner. This prize cannot be transferred by Winner or redeemed for cash and is valid only for the services detailed above, with no substitution of prize by Winner.  Limit one prize per family or household. In the event this contest is terminated before all prizes are awarded or if any prize is forfeited or unclaimed, TODAY and NBC will randomly select from remaining eligible entries an alternate winner for all remaining prize elements. Winner’s travel guest must be the age of majority in his or her state of residency or Winner must be guest’s parent or legal guardian.  All travel and hotel arrangements to be determined by TODAY and NBC in their sole discretion. Winner is solely responsible for all federal, state, and local taxes on prize, and for any ground transportation, meals, gratuities, travel upgrades, personal incidentals, and any other expenses not specified herein.  No substitution, assignment, or transfer of any prize permitted except that NBC and TODAY reserve the right to substitute prizes of equal or greater retail value.  .  Winner must travel on dates designated by TODAY and NBC. If the Winner cannot travel on specific dates authorized by TODAY and NBC, then the prize will be forfeited & awarded to an alternative winner chosen at random from all remaining eligible entries.  Winner and guest must travel on same itinerary. All travel and lodging will be at the risk of Winner and guest. If the Winner notification is returned as undeliverable, Winner is unable to travel on dates specified by NBC, Winner is ineligible or Winner declines the Prize, then the Prize will be forfeited and an alternate winner will be selected at random from all remaining eligible entries received.

5. GENERAL CONDITIONS:
Prize Winner and Winner's travel companion must sign and return an Affidavit of Eligibility and Publicity/Liability Release, before accepting the Prize. If Winner and winner's travel companion do not return these contest documents to TODAY within two (2) days of their receipt or if TODAY cannot reach the selected winner by telephone within 4 days of attempting to reach selected winner, the prize may be forfeited and an alternate Winner selected. By accepting the Prize, winners release and discharge NBC, TODAY, MSNBC, NBC's affiliated TV stations and Web sites and their parents, subsidiaries, affiliates, advertising and promotion agencies, and all their respective employees, officers, directors, representatives and agents from any liability or damage due in whole or in part to the award, acceptance, possession, use or misuse of any prize or from participation in this Contest.

This Contest is governed by these Official Rules. Each entrant warrants that he or she has read, and agrees to abide and be bound by, all Contest rules and that he or she is not prohibited from participating in this Contest by any applicable law, statute, regulation or other appropriate authority.

By submitting a complete entry form, the Winner, except where prohibited, grant NBC, MSNBC, TODAY and NBC's affiliated TV stations and Web sites and their parents, subsidiaries, affiliates, advertising and promotion agencies and all their respective employees, officers, director and representatives the right to use the winner's appearance on the TODAY show, name, likeness, picture, portrait, hometown, voice, biographical information and written submissions and written or oral statements, for advertising and promotional purposes without additional compensation unless required by law. All prizes claimed will be awarded to eligible winners.

By submitting an entry, entrants agree that all entries become the property of NBC and MSNBC and that NBC and MSNBC may use the entries for all purposes, including reproduction, broadcast and display on the Internet and in all media, including all forms of television, and for advertising and promotion without additional compensation unless required by law, and that you will have no recourse against NBC, MSNBC and NBC's affiliated TV stations and Web sites or the sponsor of this Contest or their parents, affiliates and subsidiaries and their respective employees, officers, directors, representatives and agents for any alleged or actual infringement or misappropriation of any proprietary rights in the entry.

You may only enter once. Any entries in excess of the limit will be ineligible. NBC is not responsible for any late, misdirected or incomplete entries or failure of any electronic equipment, computer transmissions and/or network connections. NBC is not responsible for any inaccuracies in information which may be used in the Contest, or for any technical or human error which may occur in the processing of the entries. NBC reserves the right to discontinue the Contest at any time.

Entrants using electronic entry must be the registered subscriber of the email account from which the entry is made. Caution: Any attempt by an entrant or any other individual to deliberately damage any online service or web site or undermine the legitimate operation of the Contest is in violation of criminal and civil laws and should such an attempt be made, NBC reserves the right to seek damages and/or other remedies from any such person to the fullest extent permitted by law. TODAY reserves the right to cancel, terminate or modify the contest if it is not capable of being completed as planned, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort, for the web-site portion of the contest.

The failure of TODAY or NBC to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of TODAY or NBC (excepting compliance with applicable codes and regulations) or other force majeure event will not be considered a breach of these Official Rules.

8. WINNER ANNOUCEMENT:
For the Winner's name watch the Today Show on Monday, February 28, 2005 or send a self-addressed, stamped envelope to "And The Winner Is...", The TODAY Show, 30 Rockefeller Plaza, New York, NY 10112.
