The trial of ex-Beatle Paul McCartney’s brother for allegedly groping a teenage waitress collapsed Friday when the judge threw out the case and said it should never have gone to court.

“The judge has directed a not guilty verdict. The trial has collapsed,” said a spokesman at Chester Crown Court.

Mike McCartney, 62, had been charged with sexually assaulting the waitress at a pub party in September 2004.

The former member of the 1960s band The Scaffold had been accused of touching the girl’s bottom when asking for more prawns at the buffet.

Judge Elgan Edwards ruled the prosecution had failed to prove that the incident was sexual in nature, local media reported.
