The producer of a biopic on the Gotti crime family says Joe Pesci backed out of the project months ago and isn't entitled to $3 million he is seeking.

Pesci sued Fiore Films in Los Angeles on Wednesday, claiming producers reneged on a deal to cast him in a starring role in the Gotti film.

Fiore Films CEO Marc Fiore says Pesci's representatives told him in writing months ago that the actor wouldn't do any work on the film until they replaced a director who left the project.

Fiore says he has tried unsuccessfully in recent weeks to work out a deal with Pesci's representatives for a smaller part.

Pesci's attorney, Brandon Tesser, says it's untrue that the actor pulled out of the film and that any casting change hadn't been conveyed to the Oscar-winner until recently.
