Today’s Family Makeover Official Rules
PRELIMINARY INFORMATION: No purchase necessary. Void where prohibited. You must be a legal U.S. resident physically residing within the Continental United States (residents of Puerto Rico and Guam are excluded from entry and participation) who is 18 years of age or older as of April 10th, 2006. Family members may be under 18 years of age. Contest begins on April 10th, 2005 and ends on April 14th, 2006.
TO ENTER: To enter, go to www.today.msnbc.com and complete the online entry form ("Entry Form"). One entry per family. The Entry Form will ask for your name, telephone number, email address and other information. Following the upload instructions on the site, you will be asked to submit a photograph of your family and an original essay of 200 words or less, telling us why you would like Today (“TODAY”) to give your family a makeover ("Submission"). Then press the submit button to submit the Entry Form, along with the Submission. All Submissions must be original, truthful, unpublished, created solely by the submitting entrant, must not have been submitted in any other competition, and must not infringe upon any rights of any third party, including but not limited to copyright, trademark, and rights of privacy and publicity. The photograph must show entrant with entrant’s family. Entries and Submissions generated by a script, macro or other automated means will be disqualified. Entries and Submissions that are incomplete, illegible or corrupted are void and will not be accepted.
You must have the permission of all persons appearing in your photograph for you to submit your photograph and permit NBCU to use the photograph and such appearances as set forth in these rules. By entering you grant TODAY and NBC Universal, Inc. (“NBCU”) a non-exclusive, perpetual license to use your photograph and Essay (in whole or in part or modified in NBCU’s sole discretion), including the appearances contained in the photograph, for use in all media now known or hereafter devised, including without limitation on the TODAY show and any promotions for the show and on the NBC MOBILE cell phone service. Your entry will not be acknowledged or returned. Any Submission that, in the sole discretion of “TODAY” and NBC, is deemed defamatory, harassing or otherwise inappropriate for publication will be disqualified.
Multiple entries received from any person or e-mail address thereafter will void all such additional entries. Entries that are incomplete or illegible are void and will not be accepted. All entries must be received before 12:00 PM Eastern Time on April 14th, 2006. By participating, entrants unconditionally accept and agree to comply with and abide by these Official Rules and the decisions of TODAY. ELIGIBILITY: Employees of NBC and its respective advertising and promotion agencies, its parent, subsidiary and joint venture companies, and members of employees' immediate families (spouses, parents, children, and siblings and their spouses) and members of the households of any of the above are not eligible.
Please note that by entering you agree that if you are chosen as a potential winner you (and three family member guests selected by you) will sign all necessary medical waiver and release forms for any and all medical examinations and procedures that may be conducted by medical professionals chosen by NBC Universal, Inc., that may be deemed necessary for the enjoyment of the prize. Entrants will also be required to consult with their personal physician prior to undergoing any medical or dental procedures.
SELECTION OF THE FINALIST: Employees of TODAY ("Judges") will review the qualifying entries and select up to FOUR finalists (each a “Finalist”). The selection and review process may occur by on a rolling basis as Essays are received, beginning on April 10th, 2006, from eligible nominations received. The judges will select in their sole discretion the Finalists based on the following equally weighted criteria: Clarity of expression, creativity and appearance (“Criteria”). Judging will be based on the Essays as well as optional telephone or personal interviews or other solicitations for more information that TODAY may elect to conduct with some or all potential Finalists. In the event of a tie, judges will break the tie by selecting the tied entrant with the most creativity. All Finalists and each of their family members will be required as a condition of continued eligibility to complete and sign an Affidavit of Eligibility, Waiver of Liability, and Publicity Release (“Contest Documents”). If for any reason any of the Finalists or their family members do not meet any of the above eligibility requirements or do not satisfactorily execute all of the Contest Documents, in TODAY’S sole discretion, the Judges may select an alternate Finalist based on the above judging criteria. The decisions of the Judges are final and Entrants must agree to be bound by these decisions. Entrants agree that TODAY may record and broadcast TODAY advising entrant that he or she has been selected as a Finalist, in TODAY’s sole discretion.
Each Finalist will be contacted no later than May 1st, 2006. Each Finalist and their families must agree to make themselves available to be in New York from May 14th –May 19th, 2006 and agree to appear live on TODAY and to otherwise be available to be videotaped by TODAY, in their homes, or in the broadcast studio in New York (or in another location selected by TODAY in its sole discretion), on dates selected by TODAY. Each Finalist (and their family guests) must agree to keep in strictest confidence and not to disclose to any person, including other entrants, or any other third party, any information whatsoever concerning the fact that they are potential finalists. Judges will then select one Winner based on the Criteria.
By entering the Contest, entrants agree to waive any right to claim any ambiguity or error in these Official Rules, or the Contest itself, and agree to be bound by these Official Rules and by all decisions of the judges and/or NBC, whose decisions are binding and final. Winners and each family member will be required to sign and return (or guest’s parent or legal guardian if guest is a minor) will also be asked to sign the Contest Documents if they have not already done so and a Medical Release. Winner’s guest should be a member of Winner’s immediate family. If Winner has fewer than four members in his or her family, makeover prize and trip will only be awarded to those members in Winner’s immediate family, in TODAY’s sole discretion. If potential Winner declines or cannot be reached after a reasonable effort has been exerted, any prize notification is undeliverable, or in the event of non-compliance with any of these requirements, the prize will be forfeited, and an alternate winner may be selected by the judges from the remaining eligible entries. Entrants must also be of good moral character. Weekend TODAY reserves the right to exclude anyone convicted of a crime (other than moving violations of a misdemeanor type that did not involve personal injury, drugs or alcohol). Entrant must have nothing in their background that would be an embarrassment to NBC News or TODAY, and entrants may not be elected officials or currently running for any political office (local, state or federal). TODAY reserves the right to exclude applicants for these or any other reasons, in TODAY’s sole editorial discretion.
If for any reason any of the Potential Winners do not meet any of the above eligibility requirements in TODAY’s sole discretion, the Judges may disqualify the entrant and/or select an alternate Potential Winner. TODAY reserves the right to make public personal information about the entrants on-air, prior to, during, or following the Contest.
PRIZE: The Prize consists of round trip coach class domestic air transportation for four (4) from major airport nearest winner’s home to New York, NY for five (5) days/ four (4) nights hotel accommodations (two rooms, double occupancy)(”Trip”). Sponsor has the right in its sole discretion to substitute ground transportation for air transportation depending on Winner’s place of residency. Outbound travel must take place April 14th, 2006 and return on April 19th, 2006 and winner must agree to travel on these dates or prize will be forfeited. Dates of departure and return are subject to change at Sponsor’s discretion.
The Prize will also consist of a makeover for a family of four as determined in TODAY’s sole discretion, consisting of the following possible items or services: haircuts, clothing, manicures, pedicures, teeth bleaching and other noninvasive or minimally invasive medical procedures (such as cosmetic dental work or other minimally invasive injectibles or fillers) deemed appropriate by a medical professional chosen by TODAY and winner’s doctor or dentist (“Make-Over”). If any portion of the Prize is declined by winner or any of winner’s guests, or if any component of the Prize is deemed inappropriate by NBC’s medical professional, that portion of the prize will be forfeited and remaining prize components shall constitute full satisfaction of the Prize without any additional compensation. Entrants agree that if selected as a Winner, Winner and Winner’s family will permit TODAY to film the makeover process, even if the entrant doesn't like the outcome of the makeover (“Footage”) and to exploit the Footage in all media now known or hereafter devised in perpetuity.
Entrants agree that TODAY makes no representations of any kind about the manner in which the Make-Over will be applied or used, nor about the likelihood of any physical, emotional or any other injury or damage arising in connection with the Make-Over, TODAY show’s airing of the Make-Over or any other related matter. Entrants agree that (a) entrants have no right to object to the outcome of the Make-Over; (b) TODAY has no obligation to restore entrants or otherwise to modify, alter, improve or change the results of any Make-Over; and (c) TODAY is in no way liable to entrant for any damage to entrant due to the Make-Over.
The approximate Total Value of Trip $3,000. The approximate Total Value of Makeovers $3,000, depending on the services provided to Winner and Winner’s family. This prize cannot be transferred by Winner or redeemed for cash and is valid only for the services and materials detailed above, with no substitution of prize by winner. Notwithstanding the above, TODAY is under no obligation to broadcast the Footage and any decision to do so is in its sole discretion. Winner must also agree to appear with their families on TODAY in connection with winner's makeover (in TODAY’s sole discretion). Acceptance of prize constitutes permission (except where prohibited) to use Winner’s name, hometown and likeness for purposes of advertising, promotion and publicity without additional compensation. In the event that any prize component is unavailable for any reason, the remaining elements of the prize shall constitute full satisfaction of Sponsors’ obligation to Winner and no additional compensation will be awarded. If for any reason any TODAY talent cannot attend the makeover, the remaining components of the prize will constitute the entire prize.
DISCLAIMER: Winner assumes all liability for any injury or damages caused or claimed to be caused by his or her participation in the contest and/or the acceptance and/or use of any prize, and releases NBC, its parent, subsidiaries, affiliates, officers, directors, and employees, (“Released Parties”) from any such liability. Released Parties assume(s) no responsibility for any injury or damage to participants as the result of the medical procedures provided participants as part of the prize, or to any other person's computer relating to or resulting from entering or downloading materials or software in connection with this contest. Released Parties are not responsible for telecommunications, network, electronic, technical or computer failures of any kind, for inaccurate transcription of entry information, errors in any promotional or marketing materials, errors in these rules, for any human or electronic error, or for entries that are stolen, misdirected, garbled, delayed by computer transmissions, lost, late, damaged, or postage due. Entry constitutes permission (except where prohibited by law) to use winner's name, city, state, likeness, voice and use and exploit the Submission for the purposes of advertising, promotion and publicity, in all media now known or hereafter discovered, worldwide, without notice, review or approval by winner and without additional compensation. Entrants must be the registered subscriber of the email account from which the entry is made. Entries will be declared made by the authorized account holder of the e-mail address submitted at time of entry. Failure to comply with these rules may result in disqualification from this promotion. NBC and TODAY reserve the right to withdraw the transmission of this contest or permanently disqualify from any promotion any person it believes has violated these rules.
The failure of TODAY and NBC to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of TODAY and NBC (excepting compliance with applicable codes and regulations) or other force majeure event will not be considered a breach of these Official Rules.
Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the state of New York, without giving effect to any choice of law or conflict of law rules (whether of the state of New York, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the state of New York. If any controversy or claim arising out of or relating to the Official Rules, or the breach of any term hereof, cannot be otherwise resolved, it shall be resolved by binding arbitration conducted in the County of New York, and administered by JAMS in accordance with its Streamlined Arbitration Rules and Procedures or subsequent versions thereof (the “JAMS Rules”). The JAMS Rules for selection of an arbitrator shall be followed, except that the arbitrator shall be an experienced arbitrator licensed to practice law in New York.
