Below is a statement from the Toy Industry Association:

Safety is a year-round priority for the toy industry. Our members work with the CPSC and other government agencies, medical professionals, child development and safety experts, and consumer groups to make certain that toys are safe. Families can feel confident as they shop for toys this holiday season and throughout the year.

Below is a statement from Maxfield and Oberton:

Maxfield and Oberton strongly disagrees with the CPSC’s lawsuit. We only market our products to adults aged 14 and over, and when used as intended there have been no incidents of multiple magnet ingestion. We have worked with the CPSC in the past and they approved our warning labels. Additionally, we developed our own magnet safety campaign, www.magnetsafety.com, to educate consumers.
