The recent Colorado high school graduate who made headlines in January for having a provocative photo banned from her yearbook was arrested Monday morning, along with her mother, after the police were called to a party at their home.

Sydney Spies, 18, allegedly obstructed a police officer, while her mother, Denise “Miki” Spies, was arrested on suspicion of contributing to the delinquency of a minor, which is a felony, according to the Durango Police Department. Miki Spies was also allegedly obstructed a police officer and resisted arrest, which are misdemeanors. Sydney was released from La Plata County jail on $500 bail early Monday morning, while Miki Spies was released on $10,000 bail on Monday morning.

At about 11:20 p.m. Sunday, police were called to a party at the home owned by Miki Spies, where they entered the backyard and found numerous minors consuming alcohol, according to the police report by officer Darrell Robertson. Police found a keg of beer and several bottles of liquor, and when they approached Miki Spies, she would not give her name or any other identification, the report states. She then began talking over Robertson and tried to “herd the crowd of partygoers into her house,’’ Robertson wrote in the report.

Spies then began walking toward her home, ignoring verbal commands from Robertson that she stop or be arrested, and she “broke into a full sprint to her front door,’’ according to the report. She ran into her bedroom and tried to slam the door on the police before she was eventually arrested while refusing to leave her bed. When the police were chasing her, the other minors at the party were able to flee the scene without being detained, according to the report. Police have not determined who purchased the alcohol, but providing a venue for minors to drink is a felony offense.

Sydney Spies was arrested for attempting to block an officer from entering the home. She resisted when officers tried to handcuff her, refusing to walk on her own and then unbuckling the seatbelt in the back of the police car and trying to flee. She started screaming and nearly kicked Robertson in the groin, according to the report.

On Jan. 9, Sydney Spies and her mother appeared on TODAY in the middle of a controversy over her yearbook photo. An aspiring model, she submitted a racy picture of her posing in a black shawl and short yellow skirt. The photo was rejected by the yearbook staff at Durango High School, and she and her mother felt it was a case of censorship by the yearbook staff, which was made up of fellow high school students.

"I honestly think (the picture) describes who I am," Sydney told Matt Lauer. "I'm an outgoing person and I really do think it’s artistic."

The incident on Monday is the second arrest in less than two months for Miki Spies, who was detained on June 24 on suspicion of trespassing, resisting arrest and obstructing a police officer, according to The Durango Herald. Spies and a local woman were reported for refusing to leave the playground at a local church at 5 a.m., and Spies became unruly and exhibited behavior consistent with someone who had consumed alcohol.

Sydney Spies is scheduled to appear in La Plata County Court on Aug. 22 for Monday’s incident, and Miki Spies is schedule to appear on Aug. 28.

    >> with her high school career winding down, sydney is learning that just trying to be yourself isn't as easy as it sounds.

    >> i really honestly think that it describes who i am. people can take it however they want, that i'm an outgoing person and i really do think it's artistic. like i said, people have their sports pictures, pictures with their horses or guitars. that's my interest.

    >> i was reading this last night. i incorrectly assumed when i first heard the story i said, okay, this is a bunch of faculty members that got together in the administration and said, this isn't the image we want for our school. then i realized, no, these are your peers. this is an editorial board made up of other students. it surprised me that they drew this hard line . did it surprise you?

    >> yeah, especially because they agreed to it in the first place. before any of this there was a 4-1 vote in my favor.

    >> what do you think changed their mind?

    >> i think it was the administration. they had a meeting with the principal and the next day their whole decision changed completely against me. they were completely against the picture .

    >> which is not supposed to happen. they are supposed to be independent of the school. isn't that correct?

    >> exactly.

    >> another thing that caught my attention is that they don't want this to be your official yearbook portrait. but as you mentioned in the piece that tamron showed us, they're okay if you buy an ad page in the book and put that photo as part of that page. so $300 make it okay.

    >> what was your reaction when you learned that?

    >> if it's going to be in the yearbook anyway, why should i not be able to have it as my senior picture ? that's what i don't understand.

    >> as a mom, when i look at the picture it's provocative. you say it's beautiful and artistic and i guess it is artistic. it's also not the run of the mill yearbook photo . you say you knew it would cause a reaction. did you think it was entirely appropriate?

    >> oh, i asked her not to do it. i said, sydney , really, is this the one you want?

    >> when your child is spreading her wings, you just want to come alongside and support them. that's what i'm doing as a mother.

    >> do you plan to take this further, sydney ? do you plan to file some kind of a suit which would draw more attention obviously to the situation? are you willing to take it that far?

    >> i don't know if i want to go that far with it. i'm still hoping that they might let me have that picture in there. but it's illegal for the administration to get involved. so that's why we have considered that option.

    >> is this going to end up with a picture of you in the yearbook that's the classic standing against a wall smiling like every other photo ?

    >> definitely not. i will find something.

    >> the principal asked when we had the meeting on friday, sydney , do you not want any picture in the yearbook ?

    >> would that be an option you would consider?

    >> if i submit another one they think is a little bit provocative, i feel like -- that second picture , i feel they are censoring me because of the situation. if they're going to censor that picture i feel they have to censor everyone. there were people saying, if they censor that they should censor my picture . i have a strapless dress.
