Tom Cruise won't press charges against reportedly trespassing neighbor

Tom Cruise isn't sending his big legal guns after his tased-and-confused neighbor. The "Jack Reacher"  star won't be pressing charges against Jason Sullivan, a neighbor who, according to police, scaled the fence around Cruise's Beverly Hills property last night and was arrested for allegedly trespassing after getting taser-zapped by security before officers arrived. "Tom's not a vindictive

"Tom's not a vindictive guy," the actor's long-time attorney, Bert Fields, told TMZ. "The guy was drunk. He didn't have malicious intent."

Tom Cruise is, however, going after Life & Style for $50 million

Property records confirm, meanwhile, that the nearby home where Sullivan has reportedly been staying is owned by Cruise's longtime agent, Kevin Huvane.

It's possible that investigators will still turn the case over to the L.A. District Attorney's Office for review, but without Cruise pursuing charges, Sullivan will most likely be in the clear.

Of course Tom Cruise wasn't home -- he's always off making movies!

The Beverly Hills Police Department told us earlier today that Sullivan, 41, lives at a property adjacent to Cruise's palatial digs and "was intoxicated at the time of the incident and may have confused himself and entered the wrong property."

Cruise wasn't home when the excitement went down. Huvane hasn't yet returned requests for comment.
